Energy, the environment, regeneration, sustainability and low carbon technologies are all issues that are important in the world in which we live. Our team of expert energy lawyers are on hand to help our clients navigate the sometimes complex legal issues surrounding energy and the environment.
Biomass Energy & Waste-to-Energy
The renewable energy sector in the UK is rapidly expanding in the area of biomass energy as well as RDF (refuse derived fuel) waste to energy (/energy from waste) – both merchant and utility-scale – and our team provide advice on the funding, development, construction, operation & maintenance, exit, refinancing (including options for asset based finance, to bond financing in a securitisation program – particularly for Western European assets/Commonwealth Nation assets), legal, documentary and agreements for these specific areas and upon related areas.
Energy Management (Energy Performance Agreements/ESCOs)
Whether its a monitoring solution, a control system, a smart-metering system or upgrades (boilers to insulation, or an aggregation of the aforementioned as services within an energy service company (ESCO), to providing virtual power plant energy management solutions across the lifetime of electricity generating plant/plants, our team at MBC are market leaders in providing renewable energy companies across the UK and internationally, with bespoke legal and structuring advice, as well as contracting solutions that include energy performance contracts.
Renewable and Low Carbon Power
Low-carbon technology is the viable alternative to traditional energy sources and helps reduce carbon dioxide emissions. MBC are one of the few specialist renewable energy law firms globally that has advised companies in the renewable energy and low carbon technology sector for many years directly, and internationally in alliance with our network of specialist lawyers. From R&D intellectual property specialist advice relating to patents, to funding, company law, projects,, development, construction, technical support to operation and maintenance, service companies (ESCOs) to tenders (public or privately procured under UK/EU procurement law and subject to any relevant UK/EU competition laws), MBC have lawyers in our firm that will always do their utmost to surpass any relevant brief to deliver their clients with a well-crafted solution attuned to the relevant stated needs. Contact our team to arrange a time for a meeting to run through where you presently sit, where you’d like to be, and the stepping stones can then be discussed as to how we can help you achieve your targets.
Renewable Energy Conveyancing
Planning and development in the renewable energy sector is going to increase across the next few years. Our renewable energy conveyancing team have advised sponsors, contractors, developers and other interested parties on agreements for lease, leases, option to lease agreements, to title issues, third party rights, and registration of property rights in solar, wind and can advise upon the same similar sorts of issues as they arise in relation to new areas of development from anaerobic digestion to biomass conversion units.
The global solar energy sector rapidly expands in the areas of rooftop mounted residential to rooftop mounted commercial, to built-in solar (BIPV), to groundmounted commercial solar plants, to concentrated solar energy (with fossil fuel application in extracting hitherto deep down inextricable deposits). Our team work with our clients to achieve the development, construction, financing, operation and maintenance of solar electricity plants of the highest quality, and this service extends to legal advice and documents that relate to refinancing and structured finance treatment of solar asset portfolios. Our legal team typically advise solar energy equity investors, debt financiers, contractors, developers, land owners and portfolio owners. Early in 2015 our legal team advised in relation to the deployment of 75MW of groundmounted in India and continue to advise organisations both in the EMEA, APAC and Americas on global solar solutions in both emerging and developed markets.
Planning, Environment and Regeneration
The UK planning legislation affecting renewable energy plants is mainly caught up in refusal of planning consent when there are local protests to the installation of a waste to energy (energy from waste) plants or wind turbine farms, however solar plants have also initially had their planning applications turned down. MBC’s non-contentious lawyers work closely with our dispute resolution team on planning appeal matters from appeal in the Planning Inspectorate to the stage of appeal of a matter before the English High Court. Issues on contamination of land, for example, by heavy metals, chemicals, oil and tar, gases, asbestos or radioactive substances, can require expert environmental legal analysis and advice and again MBC’s lawyers are on hand to provide that. Regeneration use of brownfield sites which have had a former industrial use are within the experience bank of the planning and property lawyers’ experience in MBC too, advising on major site redevelopments to change of use of small-scale units.
