Solar Energy

The global solar energy sector rapidly expands in the areas of rooftop mounted residential to rooftop mounted commercial, to built-in solar (BIPV), to groundmounted commercial solar plants, to concentrated solar energy (with fossil fuel application in extracting hitherto deep down inextricable deposits). Planning, Environment and Regeneration

The UK planning legislation affecting renewable energy plants is mainly caught up in refusal of planning consent when there are local protests to the installation of a waste to energy (energy from waste) plants or wind turbine farms, however solar plants have also initially had their planning applications turned down. MBC’s non-contentious lawyers work closely with our dispute resolution team on planning appeal matters from appeal in the Planning Inspectorate to the stage of appeal of a matter before the English High Court. Issues on contamination of land, for example, by heavy metals, chemicals, oil and tar, gases, asbestos or radioactive substances, can require expert environmental legal analysis and advice and again MBC’s lawyers are on hand to provide that. Regeneration use of brownfield sites which have had a former industrial use are within the experience bank of the planning and property lawyers’ experience in MBC too, advising on major site redevelopments to change of use of small-scale units.
